Whereas the share of John Fielder of and in the grounds demised in the before recited indentures, and the messuages erected thereon, and the rents reserved by underleases thereon, became absolutely vested in Charles Fielder, city of Bath, by virtue of the will of John Fielder. Whereas Charles Fielder died in 1821 having made his last will and testament, dated 22 July 1821, devising to George Reade, Robert Carpenter since dec'd, and James Mackenzie, all his estate in trust to be sold. Whereas Robert Carpenter died in October 1821

Whereas 2. have contracted with 3. for the absolute sale to her of John Fielders 1/4 share of and in the lands and premises. Whereas to prevent the merger and extinguishment of the terms and rents of the original lease, 3. has requested the assignment of the lands and premises to 4. in trust for the remainder of the term of 97 and a half years.
