Whereas default was made on payment of the recited principle sum of £4000. Whereas Joseph Lovell Lovell died in December 1842, and was buried in the Liberty of St. Andrew's in Wells, c. Somerset.

Whereas Dame Martha Rivers Gay made her last will and testament on 9 December 1833 appointing John Clayton Freeling, Dame Maria Stephenson, and Louisa Storey executor and executrixes thereof. Whereas Dame Martha Rivers Gay died in 1835, her said will with several Codicils thereto was proved in the Prerogative Court of Canterbury on 28 March 1835 by John Clayton Freeling and Dame Maria Stephenson only. Power being reserved to Louisa Storey to prove also, but which she has never done, nor acted in or with the executorial duties. Whereas John Clayton Freeling and Dame Maria Stephenson having been called upon by Robert Savage the Younger, in whom the mortgage debt of £4000 as secured to Thomas Savage and Joseph Lovell Lovell is now vested, to pay the same, have called upon Robert Savage the Elder as surviving trustee of the term of 500 years to raise the sum of £4243.10s to be applied to payment of the said debt and costs. Whereas Charles Pole, William Richard Hamilton, Charles Bell Ford, and Henry George Hamilton, have agreed to advance the sum of £4243.10s to Robert Savage the Elder as trustee, at interest and secured by the 4/18 shares of and in hereditaments comprised in the term of 500 years created by the aforesaid indenture of Settlement. Whereas the hereditaments comprised in the said term of 500 years are already vested in Charles Pole, William Richard Hamilton, Charles Bell Ford, and Henry George Hamilton as security on other principle sums, it has been agreed that the 4/18 shares shall be demised to a trustee.

Whereas it is understood that all the interest of Dame Martha Rivers Gay of and in the lands and premises as in 0810/3/7-8 thereby passed by and became subject to the trusts of the said indenture of Settlement. Whereas it has been agreed that in order to keep the reversions of the 2 terms of 97 and a half years and 97 years, as comprised in 0810/3/7-8, on foot as to the 2 one fourth parts they are to be assigned to Charles Ranken Vickerman upon trust.
2 one fourth shares of and in land and premises as in the lease of 25 March 1790, from 1. to 7. in trust for 6.
Consideration: £4000 from 2. to 1. in discharge of the aforesaid mortgage debt.

Whereas Sir Henry Rivers died in August 1851. Whereas the principle sum of £4243.10s was still due and owing and 4. had agreed to pay the same to 2. In consideration of the said payment in an indenture of Transfer, 20 November 1851 [as endorsed on 0810/1/94], and by a Reassignment by Deedpoll of 24 November 1851 [as endorsed on 0810/1/94], the said principle sum is now vested in 4. Charles Ranken Vickerman makes the declaration that he holds the premises in trust, firstly for 4. as security on the said mortgage debt, and secondly for the person or persons entitled to possession of the rents and profits of the same under the settlement of 19 June 1834. Consideration: The premises as within.

In consideration of the said payment in an indenture of Transfer bearing even date herewith [as endorsed on 0810/1/94], the said principle sum is now vested in 4. Charles Ranken Vickerman makes the declaration that he holds the premises in trust, firstly for 4. as security on the said mortgage debt, and secondly for the person or persons entitled to possession of the rents and profits of the same under the settlement of 19 June 1834.
