Description
Agreement, 24-25 March 1788 1. Paul Methuen of Corsham, c. Wilts., Esq., only surviving executor of the will of Joseph Langton 2. Rev. James Phillott, city of Bath, c. Somerset, Doctor in Divinity, and Sarah his wife, said Sarah being the sole Executrix named in the will of John Stevens, late of the city of Oxford, Apothecary, dec'd. 3. Robert Maltby, p. Lyncombe and Widcombe, c. Somerset, Gent., and Jane his wife heretofore Jane King, Widow of Thomas King 4. William Gore Langton, heretofore called William Gore, of Newton park, Esq., and Bridgitt his wife, who was only child of Joseph Langton 5. James Bland Burges of Nanteribba, c. Montgomery, Esq., and George Bond, Esq., Sarjeant at Law 6. Richard Lowndes of Red Lyon Square, c. Midd., Gent.
Whereas Joseph Langton died on 10 February 1779 having made his will [see 0620/A/23]. Whereas John Blagrave, John Willes and John Chapman are now dec'd, and whereas Bridgitt Langton has since attained the age of 21 years and has married with William Gore, now William Gore Langton. Whereas the principle sum of £3000 was not paid to Joseph Langton or his executors, but all interest on the same has been paid. Whereas the legal estate in the lands so mortgaged is now vested in Bridgitt Langton. Paul Methuen at the request of William Gore Langton and Bridgitt his wife, has called in the said principle debt of £3000. The said Robert Maltby not being provided of the same and having occasion for a further sum of £1000 has applied to James Bland Burges and George Bond to lend to him the sum of £4000.
All that capital messuage and barn called Lyncombe Farm, and all that tenement and garden thereunto adjoining and belonging. And also a piece of pasture ground called the Batch, and five acres of arable land to the said capital messuage near adjoining, one meadow ground called Dolemead (18a.), one parcel of land called Viniards (10a.) adjoining also to the capital messuage, one close of arable pasture called Foxhill (8a.), and one close of arable meadow or pasture ground called New Tyning (14a.), situate and being in the Westfield below the way to Englishcombe. And also all those several acres of arable land situated above the way to Englishcombe (24a.). All which said lands are in p. Lyncombe and Widcome, and are part of Lyncombe Farm. From 1. and 4. to 5. Consideration: £3000 from 5. to 1. and £1000 from 5. to 3.
Endorsed: Conveyance 30 November 1792 1. James Bland Burges, Esq., and George Bond, Esq., Sarjeant at Law 2. Robert Maltby and Jane his wife 3. William Abraham and John Salmon, both of the city of Bath, Bankers Whereas the within mentioned sums of £3000 and £1000 were not paid at the times appointed therefore, the estate and interest of 1. became absolute in law. Reciting: Surcharge, 28 May 1788 [see 0620/A/26] 1. Robert Maltby and Jane his wife 2. James Bland Burges, Esq., and George Bond, Esq., Sarjeant at Law Permises as within. Consideration: £450 from 2. to 1. Whereas both principle sums of £4000 and £450 are now due and owing together with an arrears of interest of £50.2.6 Premises as within from 1. to 3. Consideration: £4500.2.6 from 3. to 1.
Further Endorsed: Transfer, 30 November 1792 1. Richard Lowndes, James Bland Burges, George Bond, Robert Maltby and Jane his wife Richard Lowndes, a trustee of the term of 200 years, at the request and direction of Robert Maltby and Jane his wife transferes to George Watts the premises as within in trust for the remainder of a term of 200 years.
