1. Gordon Irwin Scott of Sandells, Reigate Road, Dorking, c. Surry 2. The Persons mentioned in the third column of the schedule hereto, hereinafter called the Owners [being owners of properties on the south side of Weston Road] 3. The Persons or Institutions mentioned in the fifth column of the schedule hereto, hereinafter called the Mortgagees
Whereas Mr Scott is the owner in fee simple of the piece of land situate at the rear of Weston Road coloured pink and blue on the plan annexed hereto. Whereas by virtue of several conveyances mentioned in the fourth column of the schedule hereto the Owners are entitled in fee simple to the respective pieces of land appearing opposite their names in the first column of the schedule hereto. Whereas by virtue of several mortgages mentioned in the sixth column of the schedule hereto the Mortgagees are entitled to mortgages on the several pieces of land appearing opposite their names in the first column of the schedule hereto. Whereas in the several documents mentioned in the second column John Wiltshire covenanted that he and his heirs should not make or set up or permit to be made any erection or building whatsoever save boundary walls on any part of the ground comprised within and circumscribed by the lines with the letters G.H.I.K at the four corners thereof, the said land being the lands of Mr Scott and other lands. Whereas the Owners claim that as owners of the lands so mentioned they are entitled to enforce the covenants against Mr Scott and others the owners of the said adjoining lands, but Mr Scott does not admit the said claim. Whereas for the settlement of disputes Mr Scott has agreed with the owners that the Owners shall release the said covenants in consideration of the payment by Mr Scott of the sum of £3000 and the Covenants by Mr Scott hereinafter contained.
The Owners release Mr Scott and his successors to the lands from the covenants as in column 2 of the schedule hereto. Mr Scott covenants with the Owners as to the usage of the lands. Consideration: £3000 from 1. to 2. and 3. divided between them as in the seventh and eighth columns of the schedule hereto. Plan annexed
