Berks., Widow, and Claude Edward Charles Graham Charlton, now serving in Egypt, a Captain in His Majesty's Royal Field Artillery, hereinafter called the Trustees
Reciting: 1195/15 Whereas Elizabeth Trosse Charlton made her last will on 24 April 1883, appointing her son Richard Granville Charlton sole Executor thereof, and after making certain specific bequests left her real estate and the residue of her personal estate to her said son. Whereas Elizabeth Trosse Charlton being seized in Fee Simple in the hereditaments subject to a mortgage thereon and to a Fee Farm rent hereinafter mentioned but free from other incumberences, died on 31 December 1885. Her said will being proved by Richard Granville Charlton on 13 February 1886 Whereas Elizabeth Trosse Charlton had by indenture of 5 December 1859, made between Elizabeth Trosse Charlton of the first part, the said Richard Granville Charlton of the second part, William Sackerverell Coke of the third part, Alice Charlton then Alice Coke of the fourth part, and Edward Thomas Coke and Edward Spicer Charlton as trustees of the fifth part, covenanted to pay the sum of £3000 to the said trustees but the same was not paid but securities representing the same were retained by the said Richard Granville Charlton. Whereas Richard Granville Charlton agreed with the trustees to convey his equity of redemption in the said hereditaments to them in satisfaction of the said sum thereinbefore covenanted, subject to the yearly payment of a Fee Farm rent of £7 charged on the property.
Plot, piece or parcel of land situate on the south side of Weston Lane, p. Weston, c. Somerset, and all that messuage thereon called Granville Lodge. from 1. to 2. upon trust to sell the same, with the consent of and during either the lives of Richard Granville Charlton and Alice Charlton his wife, or the survivor of them, or at their own discretion after the decease of the said Richard and Alice, and to stand possessed of the proceeds thereof under the trusts of the aforesaid indenture of 5 December 1859 being a Settlement on the marriage of Richard Granville Charlton and Alice his wife. And that until such time of sale it shall be lawful for the said trustees to lease the premises or any part thereof for a term or terms not exceeding 21 years.
