Reciting: Demise by Lease, 28 February 1801 1. John Fielder and Thomas King the Elder. 2. Thomas King the Younger Whereas John Fielder and Thomas King the Elder had projected a plan for erecting buildings on the close of ground called Beaufort Place and that Thomas King the Younger had agreed to erect and build and had actually erected and built a messuage with offices agreeable in all respects to the said plan. Plot of ground (part of the close called Bayly's Tyning) forming part of the intended pile of buildings called Beaufort Place, containing on the east 123 feet, on the west 177 feet, on the south 224 feet, and on the north 210 feet, bounded on the east by an intended road, on the west by another part of the close called Bayly's Tyning, on the south partly by London Road and partly by a lane leading to Larkhall, and on the north by another part of the close called Bayly's Tyning. And all that messuage and other erections thereon built by the said Thomas King the Younger, and other buildings to be built as in the plan endorsed thereon. Whereas Thomas King the Elder died on 5 December 1804 having made his will on 11 July 1804, bequeathing all his lands for the purposes of building in or near St. James' Square and Mount Beacon which were unlet for building, and all his share in the remaining parts of Bayly's Tyning near the Testator's house in Beaufort Place, unto his sons Thomas King the Younger and Charles King. Appointing Thomas King the Younger as sole executor. Whereas 1. had agreed to let to 3. the lands as follows. All that piece of meadow ground containing in front next to the London Road 205 feet, in length at the rear in an angular direction 191 feet, in depth on the east 179 feet, and on the west 125 feet. Bounded on the east by Beaufort Gardens, on the west by a new intended private road of 35 feet wide to lead to other parts of the close of ground belonging to John Fielder, Thomas King the Younger and Charles King, on the north by other parts of the said ground, and on the south by London Road, as shown on the plan endorsed thereon. Thomas King the Younger and Charles King. Reciting: Declaration of Trust, 28 February 1801 1. Thomas King the Younger. 2. Thomas King the Elder. Thomas King the Younger declares that the premises demised to him an indenture of even date herewith, were so demised in trust for Thomas King the Elder. Whereas by the will of John fielder, dated 14 March 1815, all his lands in St. James' Square, Marlborough Buildings, Rivers Street, Stable Lane, Fountain Buildings, and any others in the p. Walcot, were bequeathed to his son Charles Fielder, appointing Charles Fielder and George Reade as executors. Whereas by the will of Charles Fielder, dated 22 July 1821, all his estate was bequeathed to George Reade, Robert Carpenter, and James Mackenzie, in trust to sell the same. Whereas George Reade and James Mackenzie were satisfied that the close of ground called Bayly's Tyning was a burden to the estate, proposed to assign their moiety thereof to thomas King the Younger and Charles King. The half share or moiety of John Fielder of and in the parcel of ground known as Bayly's Tyning to 2.

Whereas Dame Martha Rivers Gay is now seized in fee simple and inheritance of the plot of land in reversion expectant upon the determination of the term of 99 years. Whereas Dame Martha Rivers Gay has agreed to take an assignment of the rents and lands hereinafter expressed from Thomas King in discharge of the yearly rent of £91.
2 moieties, being the whole of the piece of meadow ground as hereinbefore described, except such parts as have been demised to Thomas King in trust and to Richard Hobart, from 1. to 2., and the yearly rent sums of £7, £7, and £27, issuing out of messuages as hereinbefore recited.
