Whereas there was then due and owing from 2. to 1. the several sums of £500 and £800 and that 1 had called in the same, 2. being unprovided therewith had requested that 3. advance and pay the same along with a further sum of £200 on the securities as hereinafter expressed, to which 3. had agreed. All that close of pasture or arable ground called Primble Sleight, then late in the possession of Charles Davis, since then of William Frederick, but then of James Palmer as tenant to James Dallamore, situate in the p. Walcot. Consideration: £1300 from 3. to 1. and £200 from 3. to 2.

Whereas James Dallamore died on 20 September 1787 having made and published his last will and testament dated 27 September 1780, bequeathing to Richard Payne, Victualler, and Thomas Howell, Silversmith, both of the city of Bath, amongst other premises, the land called Pebble Sleight, to the use of Mary Dallamore, his wife, so long as she remains his widow, and after her decease or remarriage to the use of his sons James Hillier Dallamore and John Walter Dallamore in two equal moieties.

William Phillips Whereas Richard Payne died in the lifetime of the said James Dallamore, and Mary Dallamore was also deceased leaving her daughter Betty Edith Williams then Betty Edith Huggins, Widow, of full age, and her two sons James Hillier Dallamore and John Walter Dallamore, under the age of 21 years. Whereas Thomas Howell the Elder was then also deceased, having made a will appointing his wife as Executrix, an that he had a son Thomas Howell (party hereto) born after the making of his said will, the trust estates devised by the will of James Dallamore became vested in Thomas Howell the Younger as heir at law of his father. Whereas the said Thomas Howell the Younger is desirous of being relieved of the said trusts, and the said William Phillips is desirous of taking up the same. All that close of pasture or arable ground called Primble Sleight, then late in the possession of Charles Davis, since then of William Frederick, but then of James Palmer as tenant to James Dallamore, situate in the p. Walcot from 2. to 3. upon trust.
Whereas James Hillier Dallamore and John Walter Dallamore have both attained the age of 21 years. Whereas the sums of £1500 and £100 due and owing to Richard Chandler were not paid, his interest in the premises became absolute. Whereas William Phillips, with the consent of James Hillier Dallamore, John Walter Dallamore, and Betty Edith Huggins, and pursuant to the powers vested in him by the will of James Dallamore, dec'd., has sold and disposed of a messuage in Broad Street, city of Bath, to Thomas Sherry of the city of Bath, Poulterer, for £800, a nett yearly rent of £26.5s payable for the burial ground of Walcot to Charles Atkins of the city of Bath, Baker, for £540, and a close of pasture ground called Mudcombe, p. Walcot, to James Hooper of the p. Walcot, Esq., for £113.8s, which premises were part of the premises granted [on Mortgage] to Richard Chandler. Whereas the said sums making together £1453.8s have been recieved by Richard Chandler. Whereas on an account made this day there appears to be still due and owing to Richard Chandler the sum of £202. Whereas in pursuance of the power to sell vested in William Phillips, he has agreed to sell the close of ground called Pebble Slaite als. Primble Sleight to John Heath and Samuel Grimes at the cost of £202.
