Description

Whereas default was made on payment of the Mortgage debt of £4243.10s, the same still being due and owing.
Whereas Sir Henry Rivers died in July 1851, and John Clayton Freeling died in August 1853.
Whereas the principle sum of £4000, mentioned in the before recited Settlement [0810/1/79], to be secured to Thomas Savage, has long since been paid.

Whereas the principle sum of £10000 remains undischarged and the persons who are now entitled to the same have brought an action on the bond of Dame Martha Rivers gay, against Dame Maria Stephenson the surviving Executrix, to obtain payment of the said principle sum. The said Dame Maria Stephenson has requested of 1. as trustee of the estates to raise £10229.2.11 to be applied to the principle sum and costs.
Whereas 4. have, at the request of 1. and 3., agreed to advance to 1. the sum of £10229.2.11 upon the assignment of the security for the said mortgage debt to them.

Premises as in the Settlement of 18-19 June 1834 [0810/1/79], as security, from 1. to 4.

Consideration: £10229.2.11 from 4. to 1.
