Reciting: Lease and Release 19-20 December 1766 1. Sir Benet Garrard 2. John Wood, and Thomas Brock Several Pieces of land known as the The Hayes Furlong and The Hayes Lower Furlong, p Walcot, for the purpose of building a set of buildings now known as the Royal Crescent. Restrictive Covenants placed on several pieces of land called The Kingsmead Furlong, part of The Hayes Lower Furlong, and part of The Hayes.
Articles of Agreement First: That the parties of 1. release 2. from the restrictive covenants hereinbefore recited, in so far as they relate to the area of land bounded by the Upper Bristol road to the south containing 1050 ft; on the west by the road leading from the Upper Bristol Road to Marlborough Buildings containing 300 ft; on the east by a common sewer, 150 ft in length; on the southeast by a boundary wall of premises of Messrs Palmer and Sainsbury, held under lease from Dame Martha Rivers Gay, containing 320ft and extending from the common sewer northeast ward to the road adjoining the southernmost house of Queen's Parade; and on the north by the southernmost house and garden wall of Queen's Parade and the Crescent Field, containing 1395ft. For the purpose of enabling Dame Martha Rivers Gay to let for building purposes the aforesaid lands, which are also marked pink on the associated plan. Second: That 2. shall have free use of the intended new road in front of the intended new buildings, and that 2. shall give over 8ft into the road leading from teh Bristol road to the Crescent and Marlborough Buildings. Third: That 2. shall take a quantity of ground 34ft wide for making a way for chairs and foot passangers from the west end of the Gravel Walk and continuing south in line with the end of Brock Street to the intended new buildings. Fourth: 2. agrees that once the lands currently in the possessions of Robert Browne and Messrs Palmer and Sainsbury, come into their possession they will give over to the Trustees of the Bath Turnpike Road a space of about 30ft for the use of the Bristol road on the south of the ground to be let as hereinbefore mentioned. Fifth: 2. agrees to enter into restrictive covenants with respect to the Crescent Fields and their usage. Sixth: That instead of penalties which are dificult to enforce the deed shal be submitted to the settlement of the Attorney and Solicitor General. Seventh: 1 and 2 agree that all springs in the Crescent fields shall forever be kept open for the use of the inhabitants of the Crescent. Eighth: As the proceeding articles cannot be carried into execution without the sanction of an Act of Parliament, 1 and 2 agree that 2 shall apply for said act, and that if a sufficient number of signatures cannot be obtained for such or any public or general opposition should be made to the getting of such Act then these present articles shall be null and void.
