Reciting: 0626/15 Reciting: Further Mortgage, 7 July 1879 1. Benjamin Smith 2. George Moger and Alfred George Derwent Moger Premises as in 0626/15 Consideration: A sum of money at interest. Whereas Benjamin Smith died on 1 July 1882, having made the parties of 2. his Executors. Whereas George Moger died on 20 December 1880. Whereas Henry Argent Simmons has sold a portion of the lands comprised in the hereinbefore recited indenture of Mortgage under a power of sale therein contained. And there is now due and owing to the said Henry Argent Simmons the sum of £170. Whereas 2. have agreed with 3. for the sale of the said lands at the sum of £680, there being considerably more than that amount due to 3. under the before recited Further Mortgage, it has been arranged that 3. should pay to 1. the sum of £170, the balance of the purchase money to be applied in part payment of the amount due to 3.
All that piece of arable ground, p Twerton, formerly called Bastard's gate but now Cherry Orchard, numbered 429 on the Tithe map of the said parish (2a.2r.26p.), together with the cottage thereon now in the occupation of John Hearens. And also all that three cornered piece of ground (20p.), p. Twerton, bounded north by the turnpike road from Warminster to Newton St. Loe with a frontage to the said road of 240 feet, together with 3 cottage thereon erected in the occupations of Mr Eyres, Mr Holvey, and Mr Walls as weekly tenants. And also all that arable land, formerly pasture (1.a.1r.32p., formerly 2a.), p. Twerton, called Strip on Short Down, being within a few yards and on the right hand side of the lane leading from Twerton to Englishcombe, bounded north by Glebe land belonging to Twerton Vicarage, south by land late of Harriet Herbert, east by a road, and west by the turnpike road from Bristol to Frome, and all buildings and erections thereon now in the occupation of Benjamin Button and used as a Market Garden. From 1. and 2. to 3. All that three cornered piece of land (13p.) with a frontage of 135 feet adjoining the piece of land first hereinbefore mentioned. from 2. to 3. Consideration: £170 from 3. to 1. in discharge of a Mortgage debt due to him from 2., and £510 retained by 3. in part discharge of a Mortgage debt due to him.
