William Bartlett, of the city of Bristol, Distiller, a trustee for Walter Hippisley Clarke Two several closes of land called Babers and Strornburge otherwise Stanbridge, p. Tiverton otherwise Twerton, and also the piece of land known as Whitings Tining (5a.), situate on the northeast side of a road from Bath to Frome, bounded next to the said road by a stone wall. And also all that one acre of arable land being in the common field called Catt's Brain, abutting against the Whitcombe Hedge. And also one other acre of arable land being in the Southfield of Busker's Gate upon Old Noll. And also one other acre of arable land being on the west side of Marlton Field, abutting against The Berry. And also all that close of pasture called Wall Tying or Lymore Paddock (1a.), which is divided by a waggon way or lane from the close called Babers. All which said closes aforesaid form part of the Manor of Tiverton otherwise Twerton. From 1. and 2. to 3.

Whereas the said sum of £1200 and interest was not paid, the interest and estate of James Levier in the properties became absolute at law.
Reciting: Mortgage by Lease and Release, 10-11 January 1805 1. Walter Hippisley Clarke 2. Thomas Smallcombe Whereas Walter Hippisley Clarke had paid the sum of £900 to James Levier in part payment of the sum of £1200, there being then a debt of £300 still due. Lands as before recited to 2., subject to the repayment of £300 (5%) to James Levier Consideration: £3200 from 2. to 1.
Whereas the sum of £315 for principle and interest is now due to James Levier, and the sum of £3200 is now due to Thomas Smallcombe. Whereas Charles Deverell has contracted with Walter Hippisley Clarke for the purchase of the pieces of land hereinafter mentioned at the sum of £310, which it has been agreed between the parties is to go to James Levier in part discharge of the sum of £315, Walter Hippisley Clarke to pay the residue thereof, James Levier to thereupon convey the premises. And Whereas Thomas Smallcombe is satisfied that the residue of the hereditaments comprised in his mortgage are sufficient for the securing of the principle sum owed to him has consented to the conveyance.
All that close of pasture ground called Wall Tyning or Lymore Paddock (1a.) which said close is divided by a waggon way or lane from the close called Babers. And also all that one acre of arable land being in the common field called Catt's Brain, abutting against the Whitcombe Hedge. And also one other acre of arable land being on the west side of Marlton Field, abutting against The Berry. And also one other acre of arable land being in the Southfield of Busterd Gate upon Old Noll. All which said closes aforesaid form part of the Manor of Tiverton otherwise Twerton. Which said closes are now better known as or by the descriptions following, that is to say, All that close of meadow or pasture land (1a.), situate between meadow or pasture ground belonging to George Pocock and Richard Cooper, now let to James Berry by the year, partially enclosed by a stone wall and commonly called the Walled Paddock. And also a piece of arable ground (1a.) being in an open field adjoining to and on the left-hand side of a lane from Tiverton otherwise Twerton to Inglishcombe, bounded by other arable lands belonging to or in the possession of John Davis, also let to the said James Berry, and is commonly called the Lower Field in the Lower Field. And also a piece of arable land (1a.), p. Tiverton otherwise Twerton, a little above the last mentioned piece of land, and also let to the said James Berry, bounded on one side by land of the said John Davis and on the other side by land of John Dafter, commonly called The Lawn in the Lower Field. And also all that piece of arable land (2a.) called or known as Bustard Gate in the Upper Field next to Ellingtons, also let to the said James Berry, which said piece of land is within a few yards of and on the right hand side of the said lane from Tiverton otherwise Twerton to Inglishcombe. From 1. to 5 in trust for 4. Consideration: £310 from 4. to 1. by the direction of 3. and £5 from 3. to 1.
