Whereas by virtue of a Conveyance, dated 24 June 1878, between George Buckland of the one part and Frances Clare Leigh Lye, of 5 Prior Park Buildings, city of Bath, Spinster, of the other part, Frances Clare Leigh Lye became and was henceforth until the time of her death seised of the hereditaments hereinafter described in fee simple. Subject to the payment of 3 ground rents of £1.6.8 reserved by an indenture of 25 August 1768, and one further ground rent of £2 reserved by an indenture of 23 October 1770. Whereas Frances Clare Leigh Lye made her will dated 11 February 1910, being then of 14 Walcot Parade, appointing John Orr Ewing of Holmer, South Road, Weston-Super-Mare, and Octavius Augustus Glasier Collins, trustees and executors thereof and devised all her real estate to them in trust to sell the same. Whereas the Testatrix also made 3 codicils to her said will, the third, dating 29 April 1914appointing Walter James Dennis to be an executor in the place of John Orr Ewing. Whereas the testatrix died on 16 December 1916, probate being granted to the parties of 1. Whereas 1. have contracted with 2. for the absolute sale of the premises at the sum of £255.
