Whereas William Townsend, John Townsend, and Richard Hewlett were declared Bankrupt, Robert Clement and William Matthews being chosen as Assignees of their estates. Whereas proof of debts made before the commissioners against William Townsend due to Robert Clement amounted to £1108.15s, and against Richard Hewlett due to Robert Clement amounted to £138.3s, and against William Townsend due to James Cross, Zachary Bayly the Elder, Zachary Bayly the Younger, Nathaniel Bayly, Robert Gutch and Thomas Cross, Bankers of Bristol, amounted to £5476.14.6d, and against John Townsend due to the last mentioned Bankers, amounted to £5874.14.5d, and against Richard Hewlett due to the last mentioned Bankers, amounted to £9230.14.2d. Whereas James Cross, Zachary Bayly the Elder, Zachary Bayly the Younger, Nathaniel Bayly, Robert Gutch and Thomas Cross, Bankers, were declared Bankrupts in 1793, the Honourable Samuel Knollis, John Pool, William Matthews, Thomas Parsons, and others became Assignees thereof.

Whereas George Hayward Tugwell by a memorandum of 12 January 1807 declared he was acting as a trustee only for Robert Clement and William Matthews, to whom the said proofs rightly and jointly belonged. Whereas Robert Clement departed this life in 1830, having made his will 10 July 1824, bequeathing all his estate to his wife Mary Clement and appointing her sole Executrix. Whereas Ann Bush, wife of John Bush, is nest of kin to Robert Clement. Whereas disputes having arisen between John Bush, in right of his wife, and the said mary Clement respecting the validity of the said will and other matters, an agreement was entered into between the said parties, whereby probate of the said will should be taken by Mary Clement and then distribution and assignment of the estate should be made for the benefit of the several parties to the said agreement in manner agreed to. Whereby amongst other things, all debts due to Robert Clement from the estates of Thomas Townsend, William Townsend, John Townsend, and Richard Hewlett, and from John Eveleigh should be transferred to John Bush
All that share of Robert Clement of and in the several debts aforesaid, from 1. and 2. to 3. Also the lands as recited, and a 2/3 share in the fee farm rents issuing out of portions of the said lands, from 1. to 3.
