1. Isaac Carr of Twerton, c. Somerset, Esq. 2. Daniel Brown of Bath, c. Somerset, Mealman, and Frederick Brown of Luton, c. Bedford, Ironpounder.
Agreement between 1. and 2. that 1. will lease to 2. all the veins beds and seams of Coal and Fire Brick Clay which may be found under the pieces of ground in Twerton, respectively coloured Red and Green on the plan annexed hereto, for a term of 60 years from the date hereof, determinable by 2. at any time on the giving of six months notice, and by 1. at the expiration any three yearly period in which the Leesees have not produced 12000 statute Tons of Coal and on the giving of six months notice.
Consideration: £5 per annum for the first three years, and £50 per annum for each year thereafter during the term of 60 years. And for every statute Ton of Coal raised a Royalty of 6d. per Ton for the first three years and 9d. per Ton during the years thereafter, except any Coal used by the Colliery itself which is to be exempt from any Royalty. And for every statute Ton of Fire Brick Clay raised and sold a Royalty of 4d. per Ton. With an option after the first year for a further Royalty to 1. of 1/4th part of the profits upon defraying of the expenses of the Leasees. Such rents and Royalties, except the optional Royalty as aforesaid, to be paid and settled on a half yearly basis.
Covenants as to the usage of surface lands marked in Red on the attached plan for mine-workings, and rents for any such lands rendered useless by the deposit of spoil from the said mine-workings. Covenant as to payment for damages caused to lands occupied by other tennants of 1. marked in Green on the attached plan. Covenant as to the permissable use of stones mined in the area marked by cross hatches and the letters A, B, C, D, and E on the attached plan for the use in mine-workings and cottages for the workpeople of the said mines. Covenant reserving rights to 1. of all other quaries of Lime and other stone, Clay, Ores, Mines and Minerals other than the before mentioned Coal and Fire Brick Clay and Stones. Other Covenants as to the running and management of the said mine-workings Plan annexed.
