Whereas Robert Hawkins, trustee of the Settlement hereinbefore recited, died in July 1829.

Whereas John Snook, Executor of the will of William Lavington died on 7 May 1848.
Reciting: Will of Mary Ballinger, 29 October 1846 Devising to the Trustees of the aforesaid settlement the 2 several plots known as 8 and 9 Beaufort Buildings West; to be conveyed and released as soon as may be possible after her decease to her husband Christopher Ballinger and her neice Elizabeth Hyde upon trust to sell the same at public auction or private contract. The proceeds of the sale of 8 Beaufort Buildings West to be held in trust by the said Christopher Ballinger and Elizabeth Hyde for the benefit of Elizabeth Hyde for life, and after her decease to the benefit of her two daughters Harriet Harris and Mary Ballinger Harris, now Mary Ballinger Dean, wife of James Hill Dean of Bilston, c. Stafford, Japanner. The proceeds of the sale of 9 Beaufort Buildings West to be held in trust by the said Christopher Ballinger and Elizabeth Hyde for the benefit of Christopher Ballinger for life, and after his decease to the benefit of Harriet Harris and Mary Ballinger Harris, now Mary Ballinger Dean as aforesaid. Appointing Christopher Ballinger, Elizabeth Hyde and Joanna Mart Executor and Executrixes thereof. The said Testatrix died on 21 December 1851. Joanna Mart having renounced Probate or Administration thereof, special letters of Administration were granted to Christopher Ballinger and Elizabeth Hyde by the Prerogative Court of Canterbury on 28 January 1852
Whereas Christopher Ballinger died on 11 November 1858. Whereas by reason of Christopher Ballinger and Elizabeth Hyde having chosen to recieve the rents of the said premises in preference to selling the same and recieving the income thereof, no such sale has yet been effected, but the said Elizabeth Hyde is desirous of the legal estate in the said premises to be conveyed to her as per the requisition contained in the aforesaid will.
