Description
1. Rev. Sir Peter Rivers Gay, of Winchester, c. Southanpton, Baronet, one of the devisees beneficially interested of and in the real estate hereinafter mentioned, situate in the c. Somerset, late of Sir Benet Garrard heretofore of Lamer, c. Hertford, Baronet, dec'd., under and by a codicil to his will, which said Benet Garrard was a devisee of the same real estate under the will of Margaret Garrard, late of Hatton Garden. c. Middlesex, Widow, dec'd.
2. John Fielder, Thomas King, Richard Hewlett, and James Broom, all of Bath, Builders.

Reciting: Lease, 9 June 1757
1. Thomas Garrard, of the Inner Temple London (now dec'd.), and the said Margaret his wife.
2. Mary Howse, city of Bath, Widow, since dec'd.
Close or pasture ground then inclosed (2a.), between ground then late of James Bally dec'd. on the west, a ground then of John Morford on the east, a ground then of William Hooper on the north, and a ground then of Henry Matthew dec'd. on the south, situate in p. Walcot, then in the occupation of Mary Howse.

1. Margaret Garrard of Hatton Garden, Widow and relict of Thomas Garrard dec'd.
2. Isaac Axford, city of Bath, Brazier.
A close of pasture land (4a.) theretofore arable land, parcel of the West field of Walcot.
A piece of land (1a.) part of the West Field, lately inclosed therefrom.
2 pieces of land called the Sand Pitts (1a.) one of which has been converted to a garden, lying near the highway from Bath to Lansdown.
All being part of the Manor of Walcot, and in the possession of Isaac Axford.

Reciting: Will and Codicil of Sir Benet Garrard, 24 January 1767
Reciting also the will of Margaret Garrard granting the Manor of Walcot to Sir Benet Garrard, with the request that in case he had no issue he would settle the lands upon her relations, Sir Peter Rivers, Baronet, and James Rivers his brother, on the condition that they take up the name and arms of Gay.
Granting in case of accident the Manor of Walcot to Richard Phillips of Haverfordwest, Esq., and John Stokes of New Inn, c. Middlesex, upon trust to convey the same to Sir Peter Rivers.

Whereas Sir Benet Garrard departed his life soon after making his will.

Whereas the lands leased to Mary Howse are now in the possession of Dorothy Allen (formerly Dorothy Howse).
Whereas the lands leased to Isaac Axford are now in the possession of Rebecca Loftus of Sheffield (formerly Rebbeca Axford).
Whereas Sir Peter Rivers Gay, being in possession of the aforesaid pieces of land part of the Manor of Walcot, and other pieces of land also part of the Manor of Walcot late in the occupations of John Brookes, Christopher Anstey, and James Tyler, has agreed with 2. the lease of lands upon a building lease for 97 years.

Garden or pasture ground (6a.12p.) p. Walcot, late of Isaac Axford now in the occupation of Mr Strode, marked 'Nos. 41, 43, 64' on the attached plan.
2 plots of land (1r.32p.) p. Walcot, late of Isaac Axford, now in the possession of Mr Jewer and Mr Wilmot, marked 'No. 63' on the attached plan.

Consideration: £19.5s for the first year and £252 p.a. after that, and the agreement that within 4 years 2. shall expend £10000 on the construction of messuages on the demised pieces of land.
