1. Thomas Rose Drewe of Wooton Fitz Paine, c. Dorset, Esq., and Reverend John Richards of Long Bredy, c. Dorset, Clerk, trustees of a term of 500 years created of and in a sum of £300 hereinafter particularly described and intended to be assigned, by the codicil to the will of John Bragge, dec'd. 2. John Bragge of Sadborow, eldest son and heir at law of the said John Bragge, dec'd. 3. William Tucker of Coryton, c. Devon, Esq., and Elizabeth his wife, late Elizabeth Bragge, one of the daughters of the said John Bragge, dec'd, for who fortunes were secured under the term of 500 years. 4. John Bragge of Sadborow aforesaid, and Reverend Marwood Tucker of Exmouth, c. Devon, Clerk., surviving Trustees of 3. under an indenture of 8 [28] December 1789. 5. The aforesaid William Tucker and Reverend John Richards. 6. William Drewe of New Inn,c Middlesex, Gent., a trustee for 5.
Whereas John Bragge, dec'd, by his will and a later codicil gave, amongst other bequests, to Elizabeth his wife, Thomas Rose Drewe, and Reverend John Richards in trust his manor of Burstock and his farms of Burstock and Chelborough, c. Dorset and other his estates in trust for a term of 500 years from the date of his death, for the benefit of his eldest son John Bragge, with power to sell or Mortgage the same or any part thereof in event that his estate should fall short on his debts and testamentary legacies. Where as John Bragge died thereafter and his said will and codicil were proved by Thomas Rose Drewe and John Richards at the Prerogative Court of Canterbury. Whereas William Bragge died on or about the 6 July 1790 intestate and without issue having attained the age of 21, administration of his estate being granted to his brother John Bragge. Whereas Elizabeth wife of William Tucker has attained the age of 21 years on 8 October 1790, and the said William Tucker and Elizabeth have applied to Thomas Rose Drewe and John Richards for payment of the sum of £3333.6.8 being her share of and in £7000 and her legacy of £1000. Reciting: 0028F/47 Whereas the sum of £3333.6.8 to which the said William Bragge, dec'd, became entitled to at the age of 21 as his share of the aforesaid £7000 and the his legacy of £1000, was paid to him in his lifetime. Whereas all the debts and legacies of the said John Bragge, dec'd, have been paid except for the two sums of £3333.6.8 due to his daughters Elizabeth Tucker and Lucy Ann Bragge. Whereas the personal estate of John Bragge, dec'd, has been exhausted paying his said debts and legacies, it is therefore become necessary to raise the said sum of £3333.6.8 to which Elizabeth Tucker became entitled at the age of 21 by way of Mortgage on the real estates of the said will and codicil. Whereas there is now due to John Bragge as administrator of the said William Bragge, dec'd, the sum of £1000 and upwards being what remains unpaid of a sum of £1666.13.4 the portion of William Bargge under his parent's marriage settlement and which was secured upon the manor of Burstock and other hereditaments in c. Dorset. Whereas William Tucker and John Richards being possessed of a sum of £3789.7.9 which they are desirous of lending upon real security at interest, he the said John Bragge has applied to them to lend and advance the said sum, for applying the same to the sum of £3333.6.8 so due to Elizabeth Tucker and the sum of £456.1.1 in part discharge of the sum of £1000 and upwards so due to him as administrator of the estate of William Bragge. To which William Tucker and John Richards have agreed to, upon having the repayment thereof secured by a mortgage of a Fee Farm Rent of £300. And Whereas Thomas Rose Drewe and John Richards are satisfied that the residue of the estate under the two terms of 500 years created by the will and codicil of John Bragge, dec'd, are sufficient for the paying of the sum of £3333.6.8 so due to Lucy Ann Bragge under the terms of the said will and codicil.
All that annual sum or fee farm rent of £300 created by an indenture of Lease and Release of 16-17 October 1765, between James Hayne only brother and heir at law and devisee of Charles Hayne who was eldest son and heir at law and devisee of Lovelace Hayne of the one part and Henry Fisher, Mason; Thomas Jelly, Carpenter; John Ford, Mason; and Jeremiah Perry, Cabinet Maker of the other part; issuing and payable out of two closes of meadow ground situate on the west side of the City of Bath as particularly described in the said indentures, from 1. to 6. in trust for 5. Consideration: £3333.6.8 from 5. to 4. as trustees, in full satisfaction of the sums so due to Elizabeth Tucker. And also £456.1.1 from 5. to 1. as part satisfaction of the sum so due to John Bragge as administrator of the estate of William Bragge, totalling £3789.7.9 (4%)
