Reciting: Lease and Release, 28-29 September 1761 1. Charles Hayne of Newbury, c. Berkshire, Esq., since dec'd. 2. Thomas Omer and Daniel Omer, Gent., son and Heir of the said Thomas Omer Messuage or tenement, coalhose, stables, and buildings then in the occupation of Robert Holdstock as tenant to Charles Hayne, situate in p. Walcot, adjoining to the City of Bath, erected and built on part of the garden ground formerly meadow or pasture therein and hereinafter mentioned. And also all that garden ground, formerly 2 closes of meadow or pasture ground then called the Hayes, afterwords one close of ground called Russell's Close (6a.), formerly in the occupation of William Russell, after that of Thomas Rogers, but then of Robert Holdstock, Gardner, as tenant to Charle Hayne. Consideration £200 from 2. to 1. and the yearly rent of £21 for 9 years, and £90 p.a. thereafter
Whereas the name of Daniel Omer in the previously recited indenture was used in trust for and on behalf of the said Thomas Omer and his heirs and assigns.
Reciting: Surrender, 25 March 1764 1. Robert Holdstock 2. Thomas Omer Partly reciting indentures between the said Robert Holdstock and Lovelace Hayne and Charles Hayne, wherein an abatement of £11p.a. was enacted out of a rent of £32p.a., Robert Holdstock thereby became chargeable with the rent of £21p.a. for the ground called Russell's Close Whereby Thomas Omer became seized of the close called Russell's Close, and that Thomas Omer and Robert Holdstock had agreed to the surrender to Thomas Omer of part of the ground called Russell's Close as shown on the plan endorsed thereto and the messuage, tenement and buildings thereon. And that upon said surrender Thomas Omer would grant an abatement of the rent of £21 due to him of £4.7.6. All that part of the close called Russell's Close as described on the plan endorsed thereon, and the messuage, tenement and buildings thereon. Consideration: £315 from 2. to 1.
Whereas upon obtaining the surrender from Robert Holdstock, Thomas Omer laid out part of the surrendered land for a street called Alfred Street, and another part of the said ground for a street running south from Alfred Street to Prince Hoare Buildings called Bartlett Street. Whereas by several grants Thomas Omer and Daniel Omer have caused to be made several messuages or tenements in the streets called Alfred Street and Bartlett Street, the last remaining part of the surrendered land remaining with Thomas Omer and being a strip of land on the northside of Alfred Street of 2 feet 6 inches wide running the length of Alfred Street.

Lewis Clutterbuck and Daniel Clutterbuck Whereas an agreement between Thomas Omer and Lewis Clutterbuck had been reached regarding the assignment and release of ground rents due, and upon computation thereof it was found that the rents to be assigned to Lewis Clutterbuck, made up of several sums secured by Thomas Omer, exceeded the sums of £21 and £90 per year to be released by £7.8s The rent of £4.7.6 due to Thomas Omer from Prince Hoare from September last, and the several rents amounting in total to £93.12s due to Thomas Omer from the development of Alfred Street and Bartlett Street, from 1. to 2. and release of the same from 2. to 1. Consideration: £7.8s from 2. to 1.
Whereas Andrew Sproule and John Wood lately agreed to purchase from Robert Holdstock and William Holdstock, Gardners, and Frances Holdstock, Spinster, all of the city of Bath, sons and daughter of Robert Holdstock dec'd., administrators of his estate, all the leasehold estates granted to Robert Holdstock by Lovelace Hayne which were not part of the surrender to Thomas Omer, for the remainder of the term of 21 years granted by Lovelace Hayne, to expire at Michalmas 1770, subject to the payment of the rent of £16.12.6

Andrew Sproule, John Wood, and Edward Daniel a person named in trust for Andrew Sproule and John Wood All that part of the close sometime ago called Russell's Close and then called Holdstock's Garden, as was not included in the surrender from Robert Holdstock to Thomas Omer, and as was not included in the grants of several parcells of the said surrendered land. Consideration: £525 from 2. to 1. and the sum of £157.10s p.a. from 2. to 1.
Whereas the paties of 3. and other the persons named in Articles of Agreement dated 1 May 1769 [0028A/1] have proposed to purchase the plot of ground hereinafter described in order to build a messuage or tenement and Assembly Room for the convenience of persons resorting to the City of Bath, with the Intrest in the said buildings to be considered as divided into seventy parts or shares, and they have agreed with the said Andrew Sproule and John Wood to purchase the same.
Now this indenture: Plot of ground, p. Walcot, near the City of Bath, part of the close of ground formerly called The Hayes, afterwards Russell's Close, lately Holdstock's Garden, part of the ground hereinbefore mentioned to have been convyed by Thomas Omer to Andrew Sproule and John Wood, containing in length from north to south 146 feet, bounded on the east by land belonging to the Corporation of Bath, on the west by land belonging to John Wood, on the north by a street called Bennet Street, and on the south by a street called Alfred Street from 1. to 2. and 3. in trust Consideration: £42 from Andrew Sproule, John Wood and Edward Daniel to Thomas Omer, and the yearly rent of £20 from 2. to Thomas Omer during the term of 10,000 years.
